LUCKNOW (CoinChapter.com) — The United States government has sued Elon Musk’s SpaceX.
The lawsuit, filed by the Justice Department, centers around accusations of discriminatory practices in the company’s hiring process, specifically concerning asylees and refugees. This latest development adds a new layer of complexity to the legal challenges surrounding Musk’s ventures.
The lawsuit contends that SpaceX actively discouraged asylees and refugees from applying for employment opportunities and further alleged that the company categorically denied them job offers.
This conduct contradicts the principles in the Immigration and Nationality Act (INA), which explicitly prohibits such biases in employment. By refusing to consider asylees and refugees, SpaceX appears to have run afoul of the law.
The troubling allegations span a period from September 2018 to May 2022. The rationale behind these actions, according to the lawsuit, was the applicants’ citizenship status, a clear infringement of the Immigration and Nationality Act (INA).
Elon Musk’s influence in the tech industry has been pervasive, marked by his involvement in various prominent ventures.
His acquisition of X (formerly known as Twitter) expanded his presence in the public eye, augmenting his portfolio that includes Tesla, SpaceX, and Neurolink. This lawsuit, however, thrusts SpaceX into a legal battle with the US government, raising questions about the company’s practices.
Another grave allegation of the lawsuit relates to SpaceX’s reference to “export control laws” in its job postings.
SpaceX allegedly created barriers for asylees and refugees to join its workforce. It disseminated inaccurate information through job postings and public statements, misinforming potential candidates that they were limited to hiring only US citizens and lawful permanent residents due to “export control laws.”
However, the lawsuit challenges this stance, asserting that the export control laws do not impose any restrictions on hiring practices.
Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division emphasized the seriousness of the matter, stating:
“Our investigation found that SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law.”
The lawsuit’s contentions gain further strength by highlighting the status of asylees and refugees under the export control laws. These individuals hold “permission to live and work in the United States” for a limited duration.
This places them on equal footing with US citizens and lawful permanent residents within the framework of export control laws.
